　清水は中世の｢自検断｣について言及してるのでしょうね。↓

□『「処刑か追放刑（追い出す）か、このような村の秩序を守る習俗を、この時代には、よく「自検断」といっていた。村自身が自分の村中の警察権や裁判権をもち、なにか犯罪の疑いがあれば、厳しく確かめもせずに、噂だけで被疑者を死刑や追放刑に処し、遺された家財などを、村の長老たちが勝手に山分けして没収していた。ふつう中世の村で「罪科」といえば、追放刑を意味していたほど、追放刑はことにしばしば行われ、村人たちを恐怖の底に陥れていた。その「村の自検断」が、いつしかリンチ（私刑）と化し、度を超すようになって、問題になっていたらしい』

　とはいえ下記のように、行き過ぎた私刑が自然に抑制されていった過程をみると抑制の兆候がない、アフリカの辺境(ソマリランド？ソマリア？)と似ているという指摘は変だなと思います。
･村掟－暴力の克服
　1461年琵琶湖北岸の菅浦村に「惣庄置文」が残されている。置文とは村のおきてのことであり、村人達が集まって総意として申し合わせた事項である。「惣庄の力を合わせ、人を損ない、いわれなく人を処罰することをやめよう」という内容であった。粗暴な村の暴力が蔓延っていた時代で、処刑、追放のような村の秩序を守る習俗を「自検断」と呼んでいた。「下克上」の応仁の乱から戦国時代に続く風潮で、自治権を強めていた農村、国領では一種の恐怖政治も行なわれていた。この菅浦村の新しい取り決めは、村人の穏かな生活を望む方向を示すものとして注目される。1483年同じ菅浦村では「地下置文」（村掟）でさらに詳細を次のように申し合わせた。
一、根拠の無い理由で死罪、追放された時には、その者の遺産はその子に相続させる。
二、お寺の住職を理由あって追放した場合、遺された寺領、仏物などは保全する。
三、近年無情なおしおきが繰り返され、かわいそうなのでもう一度村全体で申し合わせる。この決定に背いた者は罪科に処する。
　村の安定した生活への願いが家の保存と存続という形に掟が申しあわれた。1449年信濃の高梨一族置目には、出奔、逃散した百姓の財産を領主が勝手に没収するのはやめようと定めらた。戦国時代も終わりになると世の中に平和と秩序が回復し、追放処分で逃げた農民を呼び戻す「還住」、「召し返し」が行なわれ、1568年菅浦村では戦国大名浅井氏が仲介して、召し返しの取り決めが行なわれた。遺された家財が存在する時は親子に引き渡すこと、田畠も引き渡すという内容で、それについて大名が証人になるということであった。過酷な中世の掟では罪人の遺産は没収・破却勝手が当然と見なされていたのが、中世後期には家族に相続を原則とした。
