 細野祐二氏の書いていることはよくわかりませんが、仮に、その結論「政治資金規正法違反に当たらない」が正しければ、無罪にするしかないんじゃないでしょうか?
 犯罪行為に一切当たらないのに、「背景事実」が悪質だから刑事処罰するというのでは、ドイツ人どころか、どこの自由主義国の国民に対しても、恥ずかしくて公言できない話です。
 もっとも、細野氏の結論が間違っていたり、あるいは、別途、悪質?な事案で起訴し直して処罰することは、ありうると思いますが。

 刑法第38条に「法律を知らざるを以って罪を犯す意なしと為すことを得ず」とあります。 
 これは、法の一般原則の一つである「法の無知はこれを許さず」を条文化したものであり、

これは罰則を伴うあらゆる法律にあてはまります。
 ですから、石川議員に会計知識がなかったことは事実らしいとしても、そのために同議員が政治資金規正法の解釈を誤ったという主張(=法の無知の抗弁)を行うことによって、同法違反の認定を免れることはできないのです。
 そもそも、細野会計士は法律解釈の専門家ではないので政治資金規正法についての彼の解釈が正しいかどうかは保証の限りではないところ、彼の同法解釈が仮に正しいとしても、同会計士自身、「石川議員は例の小沢氏からの仮受金をせっかく定期預金で返済して簿外化したにもかかわらず、年が代わって平成16年の政治資金収支報告書を作成する段になり、定期預金が陸山会のままで名義変更されていないことにハタと気がつき、これはマズイとばかりに、政治資金収支報告書に定期預金を計上してしまったのである。小沢氏の個人資産を政治団体の資産として計上するというのであるから、当然のことながら政治団体の資産は4億円分だけ過大計上されて貸借が合わない。そこで、たまたま問題の世田谷の宅地の登記が12月末に間に合わなかったことを思い出し、ならばこちらも4億円近いので、定期預金をこの年度に計上する代わりに不動産を翌年回しにしておけばちょうど辻褄が合うと考えたのではないか?見よ。石川議員の経理処理は翌平成17年以降に見事に辻褄が合い、平成17年に4億円の事務所費が計上されるや、平成17年と平成18年にかけて4億円の定期預金は消滅している。」と同議員が虚偽記載をしていると認定しているのですから、同議員の同法違反は明らかです。
 その上、「石川議員以下3名は政治資金収支報告書の虚偽記載を認め、本件は自白事件として処理されることになった。」と、石川議員らが故意に虚偽記載をしたと自供しているのですから、何をかいわんやです。

 日本政府の安全保障政策は帯に短し襷に長しとちぐはぐである、との太田さんのつっこみはもっともであると考えますが、ORSが頓挫する可能性はあるにせよ、意外に防衛省の中には極少数の先を見通す眼を持っている人間がいるのではないか、というのが以上のオープンソースから作れる仮説かと思いますが、いかがでしょうか?
 もしこれが、防衛省によるORSへの早期イニシャチブだとしても、それは日本政府による自発的なものではなくアメリカ政府から促がされたものである、という見方のほうが正しいのでしょうか?

 申し訳ないが、お示しの資料を読んだだけでは、Operationally Responsive Space(ORS)なるものについて、よく飲み込めませんでした。
 よって、全日空と航空自衛隊からぞれぞれパイロットが宇宙飛行士要員となったことと、このORSとに関係について、(旧防衛庁と旧運輸省が犬猿の仲であった記憶に照らしただけでも、)私自身は関係ないと思うのですが、そう断言することもまたできません。
 もう少し、あなた自身の推論なり分析なりをご提示いただきたいと思います。
 
 ところで、核弾道弾の空中レーザー迎撃(コラム#3829、3835)についてのフォロー記事が朝鮮日報に出てました。↓

プリウスのブレーキ「問題」について
Toyota has announced a voluntary safety recall on approximately 133,000 2010 Prius and 14,500 2010 Lexus HS 250h hybrid cars to update software in the anti-lock brake system (ABS). The brake system has been found to have inconsistent brake feel in some situations, particularly partial braking on rough or slick road surfaces when ABS is activated…The National Highway Traffic Safety Administration (NHTSA) has described the problem as a “momentary loss of braking capability.”…If you experience the momentary loss in braking, NHTSA advises owners to continue to firmly press on the brake to stop the vehicle. It would be wise to leave a little more stopping distance until this recall is performed.

The saintly Prius has been dragged into the Toyota recall vortex.
It seems that in certain circumstances the ABS system gives too much kickback through the brake pedal. Drivers tend to think this means braking action is delayed. It isn’t – if they don’t lift their foot they’ll find the brakes work as normal.
But a software re-flash of the affected cars will change the feedback in the circumstances in question, and everyone should be happy.
It affects only the Mk3 Prius, and only the first few months’ production. Brand-new ones are fine.
That’s because Toyota recognised the issue some while ago after some customer comments. It modified the software on Priuses built after a certain date. Older cars will now get a simple upgrade to this new software.
There was no recall at the time. Toyota didn’t think it was a safety issue – the brakes always work fine. But I guess Prius drivers aren’t the type to habitually drive right up to the ragged edge, so they don’t know what ABS intervention feels like. When they experience it, they’re spooked.
And now, because everything Toyota says and does is viewed through the lens of ‘safety’ and ‘recalls’, the company has to be super-cautious. It gets badgered by the media if it doesn’t act. In normal circumstances this wouldn’t be a recall.
Seen from the outside, Toyota seems to be having a PR catastrophe. But remember, the company has built its business on loyal customers. It has just taken delivery of its first batch of redesigned accelerator parts from the main accelerator recall. This has taken just days. It has made contact with owners, again in days.
Most recalls take months. And it’s not as if recalls are unusual. There are about a million recalled cars in the UK each year.
Dealers and the HQ have been working overnight and at weekends. It’s a mammoth effort, and it’s directed not at finessing the media but at fixing the cars. People who buy Toyotas trust Toyota and its dealers. That’s where they choose to get their information, not from scare stories in the tabloids.
Toyota is trusting that this will be the way to ensure the damage of the recalls – both to the customers and to its own reputation – gets healed rapidly.

Toyota and Lexus models for 2008 had a much greater incidence of sudden, unintended acceleration than other brands, according to Consumer Reports’ analysis of a National Highway Traffic Safety Administration (NHTSA) safety complaints database…In analyzing all 5,916 reports on 2008 models, Consumer Reports’ Auto Test Center and Statistics Department identified 166 cases in which the complaint described sustained unintended acceleration that the driver found difficult or impossible to control…We used 2008 models to provide a snapshot across all automakers and identify possible issues. The scope was further narrowed to complaints submitted before Aug. 28, 2009, when a California family was killed in a Lexus sedan experiencing
uncontrollable acceleration, to eliminate the impact media coverage had in drawing more submissions.
Toyota, Lexus lead with complaints
The sudden-acceleration incidents were distributed over 22 brands, but they were not spread evenly. Forty-seven complaints were about Toyota models and five were for Lexus vehicles. Between them, Toyota and Lexus accounted for more than a third of all the unintended-acceleration incidents we found among 2008-model vehicles. Seen another way, Toyota racked up more unintended-acceleration complaints than Chrysler, GM, Honda, and Nissan combined.

The bottom line
Because it is dependent upon motorist submissions, the NHTSA complaint database does not reflect all sudden, unintended acceleration cases. But the data does show statistically more complaints for certain Toyota, Lexus, and Ford brand models.
Another way of looking at the extent of complaints is to compare them to model-year sales. Based on our analysis, the ratio of reports for experiencing such a problem on 2008 model-year vehicle from Toyota Motor Corporation is about one in nearly 50,000. The Ford Motor Company’s reported risk is about one in nearly 65,000. In contrast, the reported risk for a GM model is just one in 500,000.

In 1986, the television program 60 Minutes started Audi’s “unintended acceleration” scandal. The show trotted out tearful people, recounted death and carnage, spoke to so-called experts, and generally made it seem like the vehicle in question, the Audi 5000, was a roving menace with a mind of its own. In the end, the U.S. government determined that every single so-called unintended acceleration accident was the result of driver error. Some speculated that because Audi’s pedals were closer together than those of some other brands, people were too uncoordinated to choose the correct one. The pedal-placement issue Audi faced at that time parallels the throttle-kill issue Toyota faces now.

…It’s hard to be exact about the human peril. But from the reports of the number of accidents attributable to the two separate Toyota accelerator issues, it seems to be about 15 deaths in the US, though none as far as we know in Europe. That is carnage. Lots of separate human disasters.
But we’re talking about 10 million cars, driven on average for three years or more. Frankly, the actual risk is far smaller than the risk from inattention, a badly fixed load, texting on the move, wrong tyre pressures or any number of other things under the driver’s control.

They also criticized what they called “aggressive and questionable” news coverage “when the real story is how quickly Toyota identified the
problems, found solutions and delivered those solutions to its dealers worldwide.”

 せっかく大変な労力と時間をかけて投稿していただいたので、はしょらずにコラムに収録しましたが、後一歩、踏み込んだ「解説」をつけていただきたかったと思います。
 いずれにせよ、かつてのアウディ(フォルクスワーゲン)叩きはナチ叩き、現在のトヨタ叩きは黄色人種叩きってのが米国の多数派の深層心理だと私自身は勘ぐってます。
 トヨタ社長米議会公聴会出席問題の米国での報道ぶり↓を見て、改めてそう思うな。
